A set of laws declaring the duties of parents
The responsibilities of parents are enshrined in Part 2, Article 38 of the Constitution of the Russian Federation, which emphasizes that the father and mother have equal responsibilities for the maintenance and upbringing of children.Both parents are responsible for raising the child.parentPhoto: GettyArticles 63, 62 and 65 of the Family Code specify the duties of parents to their children. In particular, it is stated that parents cannot represent the interests of children when there is a conflict with the interests of the parents. Parents may be held criminally liable under 2 articles of the Criminal Code of the Russian Federation:
- Art. 156 of the Criminal Code regulates responsibility for poor performance of obligations, which is associated with cruelty towards the child.
- Art. 157 of the Criminal Code is aimed at punishment for non-payment of alimony.
The last article as punishmentinvolves the arrest of the parent and forced labor. Civil liability of parents is associated with poor performance of their obligations to the child. If inaction, improper care, lack of food or clothing led to damage to the health of the child, then under Art. 151, 1064, 1099 of the Civil Code of the Russian Federation, parents can be held liable. They can be required to pay compensation for moral damage or damages.
Failure to perform duties properly
The Family Code lists the cases when a child can be taken away from a parent. Article 69 lists the circumstances when parents cannot continue to raise a child:
- if you do not pay alimony;
- Do not take the child from the hospital or other children's institutions;
- tolerate child abuse;
- if committed a crime in relation to a spouse or child.
The state does not allow alcoholics and drug addicts to raise children.
Realization of children's rights through the responsibilities of parents
According to the law, a child must receivecare, education, physical and moral upbringing. If parents ignore their responsibilities and the child commits an offense, then the parents are responsible for it. Federal Act No. 436-03, issued in 2010, protects children from information with scenes of violence, cruelty, pornography. Children cannot be shown or allowed to see calls to take drugs or alcohol. Parents or guardians who allow this can be brought to administrative responsibility. Adequate parents should not be reminded of the measures of responsibility for the child. They would rather play it safe than allow the child to suffer.
